iBLINK “RECESS HIGH SCORE CONTEST” COMPLETE OFFICIAL RULES
NO PURCHASE NECESSARY
A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Open only to legal residents of the fifty United States and the District of Columbia.  Entrants must be at least 18 years of age or older at time of entry. If 18 is not the age of majority in the jurisdiction in which entrant resides, entrant will need to obtain permission from their parent/legal guardian in order to enter and be declared a winner.  Entry requires Internet access.  Void where prohibited. Contest begins at or about 12:00:01 a.m. Central Time (CT) on August 1, 2009 and ends at 11:59:59 p.m. CT on July 31, 2010 (the “Promotion Period”).  All entries must be received by 11:59:59 p.m. CT on July 31, 2010.  Employees of Elexa Consumer Products, Inc. (“Sponsor”) and their immediate families (i.e., parents, spouse, children, siblings, grandparents, step parents, step children and step siblings) are not eligible to enter this Contest.
HOW TO ENTER
Access www.myiblinkusa.com (the “Website”) and click on “Recess.” Login or complete the registration information requested in the information fields (full name; complete address [no P.O. Boxes]; birth date; daytime phone number, including area code; and e-mail address, and verification that you have read and understand the Website’s Privacy Policy and Terms and Conditions, and have read and complied with these Complete Official Rules). Play the Recess “Speedball” game and click Submit to submit your score.  In the event of a dispute about scores submitted by multiple individuals using the same e-mail address, the scores will be deemed to have been submitted by the authorized subscriber of the e-mail account used to enter the Contest at the actual time of submission. The name of the authorized account holder associated with any given e-mail address will be deemed to be the entrant and must comply with these Complete Official Rules. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet-access provider, online-service provider, or another organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. No software-generated, robotic, programmed, script, macro or other automated online entries are permitted.  Entrants assume all risk of lost, late, misdirected, incomplete, or illegible entries.  You may play as often as you wish, but only your highest score during a month will be a candidate for that month’s prize.
 
SELECTION OF WINNERS
This promotion consists of twelve (12) separate monthly contests, with one (1) Prize awarded during each month. The highest score received by 11:59:59 p.m. CT on each “Entry Deadline” indicated below will be the prizewinner for the corresponding calendar month; in the event of a tie for highest score, the winner will be selected at random from among the entrants with tied scores.  All scores will be reset following the Entry Deadline; winning and nonwinning scores will not be carried over to the next month.

Scores must be received by 11:59:59 p.m. CT on the Entry Deadline for consideration in the corresponding calendar month’s contest.  The determination of the high score winner will be made by Sponsor, whose decisions are final and binding on all matters regarding this contest. Nonwinners will not be notified of their nonwinning status.  Participants agree to be bound by these Complete Official Rules and the decisions of the Sponsor. All prizes will be awarded assuming sufficient eligible entries.

Each Prize will consist of one (1) set of iblink™ headphones, Approximate Retail Value (ARV): $29.99. ARV of all prizes: $359.88.
GENERAL CONDITIONS
Each potential prizewinner will be notified by e-mail, U.S. mail, telephone, or private delivery service (at Sponsor's sole discretion) and may be required to sign and return an Affidavit of Eligibility and Release of Publicity (where permitted by law) and Liability within five (5) days of notification. In the event of noncompliance, if a prizewinner cannot be reached at the phone number, e-mail address, or address on that winner's entry, or if prize or prize notification is returned as unclaimed or undeliverable for whatever reason beyond the control of Sponsor, that prize will be forfeited, and an alternate winner will be selected. Depictions of prizes in Contest-related materials are for illustrative purposes only and may not be actual prizes provided. Sponsor is not responsible for invalid or incorrect e-mail addresses. No substitution of any prizes will be offered, except at Sponsor's sole discretion. No prize transfer is permitted. If a prize is unavailable, Sponsor reserves the sole right to substitute a prize of equal or greater value. Limit of one prize per person, mailing address, or e-mail address. All taxes, fees, and surcharges on prizes are the sole responsibility of each prizewinner. By participating and accepting a prize, where permitted by law, the winner grants to Sponsor (and agrees to confirm that grant in writing) and those acting pursuant to the authority of Sponsor, the right to print, publish, broadcast, and use-worldwide in any media now known or hereafter developed, including, but not limited to, the World Wide Web-at any time(s), the winner's name, portrait, picture, voice, likeness, and biographical information as news or information and for advertising and promotional purposes without additional compensation or review.  All interpretations of these Complete Official Rules and decisions by Sponsor are final and binding. Sponsor reserves the right in its sole discretion to disqualify any entrant it suspects or finds: (i) to have used a software-generated, robotic, programmed, script, macro or other automated online entry; (ii) to have tampered with the entry process or the operation of this Contest; (iii) to be acting in violation of these Complete Official Rules; (iv) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or (v) to have provided inaccurate information on any legal documents submitted in connection with this Contest.
CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
RELEASE OF LIABILITY
All entrants agree to indemnify, hold harmless and release Sponsor; its affiliates, subsidiaries, and distributors; the service agencies and independent contractors of any of the above organizations; their respective officers, directors, employees, and agents (including advertising and promotion agencies); and all others associated with the development and execution of this Contest from any and all liability with respect to or in any way arising from this Contest, including but not limited to claims arising from a Design’s infringement of third-party intellectual property rights; participation in any Contest-related activity; and/or delivery/misdelivery, acceptance, possession, use, or misuse of a prize, including, but not limited to, liability for personal injury, bodily injury (including wrongful death or disability), damage to property, and damage or loss of any other kind. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by any of the equipment or programming associated with or used in the Contest, or by any technical or human error that might occur in the processing of submissions in the Contest. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications-line failure, theft, destruction, unauthorized access to, or alteration of entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines; providers; computer equipment; or computer software or for failure of text or online entry on account of technical problems or traffic congestion, including injury or damage to the participant's or to any person's computer related to or resulting from participating in or downloading materials for or from this Contest. Sponsor is not responsible for user cheating or fraud by any entrants. Any activities intended to disrupt or interfere with the proper administration of the Contest or to defraud Sponsor in any way will be prosecuted to the fullest extent of the law. Participants who engage in any of the foregoing activities will be disqualified and will forfeit any prizes won. Only the number of each prize set forth in these Complete Official Rules will be awarded. If, for any reason, the Contest is not capable of running as planned due to, without limitation, tampering; unauthorized intervention; fraud; technical failures; or any other causes beyond the control of Sponsor that, in the sole opinion of Sponsor, could corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Contest and to select a winner from all eligible entries received as of the date of termination.
DISPUTES. THIS CONTEST IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF NEW YORK, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES
As a condition of participating in this Contest, each participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, exclusively before a state or federal court located in Cook County, Illinois, having jurisdiction. Each entrant waives any and all objections to jurisdiction and venue in these courts and hereby submits to the jurisdiction of those courts.  Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for and hereby waives all rights to claim punitive; incidental; or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this Contest), and participant further waives all rights to have damages multiplied or increased.
